InsaneScouter's staff and volunteers have the right to reject any ad for any reason in its sole discretion. Ads that are not family appropriate, for example due to content, nature of the product service or business, will be rejected outright. We strive to pre-approve all ads prior to payment, but if we happen to rejected an ad after payment a full refund will be provided.

Ad Graphic
You will provide graphical ads as jpg, gif, or png ready to be displayed on our site. Our fees do not include creation of graphics or any other kind of ad for you.

Services To Be Render
InsaneScouter agrees to display the client provided ad(s) as outlined for there desired package(s) on the packages page (http://insanescouter.org/p/3541/0/packages.html).

Fees
The client agrees to pay InsaneScouter the for there desired package as outlined on the packages page (http://insanescouter.org/p/3541/0/packages.html). All fees will be paid via paypal (using this page (http://insanescouter.org/p/3542/0/Buy_Advertising.html) and will be recurring, unless other wise agreed to.

Cancellation / Refunds
Do to the nature of advertising, generally you many only cancel your advertising prior to the next payment cycle. However, we understand circumstances my come up, thus, on a case by case basis we may consider cancellation / refund requests. If we decided to offer a refund it will be prorated by taking the total number of months you paid for, the number of remaining months, and the amount you paid to calculate the amount you pay a month. Then we will then take the calculated amount you pay a month and multiply it by number of moths remaining to get the refund amount.

Limitation of Liability, Indemnification
Neither party will be liable to the other for special, indirect or consequential damages incurred or suffered by the other arising as a result of or related to the performance of the terms of this Agreement, whether in contract, tort or otherwise, even if the other has been advised of the possibility of such loss or damages. Client will indemnify and hold InsaneScouter harmless against any claims incurred by InsaneScouter arising out of or in conjunction with the placement or display of any Advertisement or Client’s breach of the Agreement as well as all reasonable costs, expenses and attorneys’ fees incurred therein. InsaneScouter's total liability under this Agreement with respect to the Advertisements, regardless of cause or theory of recovery, will not exceed the total amount of fees paid by Client to InsaneScouter.

Relation of Parties
The performance by InsaneScouter of its duties and obligations under this Agreement will be that of an independent contractor, and nothing in this Agreement will create or imply an agency relationship between InsaneScouter and the Client, nor will this Agreement be deemed to constitute a joint venture or partnership between the parties.

Non-assignment
Neither party will assign this Agreement, in whole or in part, without the prior written consent of the other party. This Agreement will inure to the benefit of, and be binding upon the parties hereto, together with their respective legal representatives, successors, and assigns, as permitted herein. Arbitration Any dispute arising under this Agreement will be subject to binding arbitration by a single Arbitrator with the American Arbitration Association (AAA), in accordance with its relevant industry rules, if any. The parties agree that this Agreement will be governed by and construed and interpreted in accordance with the laws of the State of Nevada. The arbitration will be held in Las Vegas, NV. The arbitrator will have the authority to grant injunctive relief and specific performance to enforce the terms of this Agreement. Judgment on any award rendered by the Arbitrator may be entered in any Court of competent jurisdiction.

Attorneys’ Fees
If any litigation or arbitration is necessary to enforce the terms of this Agreement, the prevailing party will be entitled to reasonable attorneys’ fees and costs.

Entire Understanding
This agreement thereto constitute the sole contract between InsaneScouter and the Client. This agreement can only be changed by mutual agreement of InsaneScouter and the Client.

By becoming a InsaneScouter advertiser, the Client agrees to all the terms contained with in this agreement, just as if they signed this agreement.
